The Emulator Strikes Back

Bleem counterclaim against Sony

The ongoing battle between Sony Computer Entertainment of America and the makers of the bleem! PlayStation emulator has entered a new phase, following a series of rulings in favour of the smaller company. Of particular note, Judge Charles A Legge granted Bleem's motion for leave to amend and assert counterclaims against the electronics giant.

This decision comes after a week in which Sony stepped up their efforts against Bleem. They served subpoenas on ten of Bleem's biggest retail clients, demanding detailed information regarding purchasing, sales, promotion and profits resulting from sales of the bleem! Emulator.

"What we have here is a pretty transparent attempt by Sony to intimidate the retailers into pulling bleem! from their shelves," said Jon Hangartner, lead attorney for Bleem. "Even if Sony's subpoenas weren't invalid on their face, the information they request is irrelevant to the lawsuit. These subpoenas have nothing to do with potential damages; they only serve to scare bleem!'s vendors into thinking they might be Sony's next target."

But can the spunky little upstart afford to go head-to-head with Sony indefinitely? We reckon they'll be hoping for a sprint rather than a marathon.
